ORDER

(Order of the Court was made by Dr.Anita Sumanth J.) Mr.R.Muniyapparaj, learned Additional Public Prosecutor assisted by Mr.M.Sylvester John, learned counsel accepts notice for the respondents and is armed with instructions to enable a final disposal of this matter. Hence, by consent of both sides, a final order is passed in this HCP.

2. This HCP is filed by a 22 year old woman seeking issuance of a Writ of Habeas Corpus to produce her husband Boopathi, S/o of Vijayakumar. We do not find, either in the FIR or in the affidavit filed in support of the Writ Petition, any averment in support of the position that the said Boopathi is in illegal detention. In fact, the very case of the petitioner is that he has eloped with R3. In such circumstances, the question of maintaining the present HCP would not arise.

3. Needless to state that this would not exonerate the State from doing the needful to act on both the complaint of the petitioner for man missing and the complaint of the family members of R3 for woman missing and secure them as expeditiously as possible, and in accordance with law.
