The present petition has been filed to direct the respondent to register a case based on the complaint given by the petitioner dated 29.09.2015 and investigate the same.
2. The petitioner submits that he is a Ceylone repatriate and belongs to economically weaker section. He made a representation to the Government for allotment of houses. In this regard, one Dhanapal gave assurance to the Ceylon repatriates that he will get patta for them and also collected huge amount from the petitioner and others. When the petitioner questioned the same, said Dhanapal along with 15 persons https://hcservices.ecourts.gov.in/hcservices/
attacked the petitioner and one C.Selvarathinam in the campus of the Information Commission. Hence, the petitioner and said Selvarathinam lodged a complaint. Since the complaint given by the petitioner was not taken on file, the petitioner came forward to file this petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. The learned Additional Public Prosecutor submitted that the complaint given by the petitioner does not contain material particulars and hence, the petitioner may be directed to give a fresh complaint.
5. Considering the rival submissions, this Court directs the petitioner to give a fresh complaint containing all particulars to the respondent within a period of one week from the date of receipt of a copy of this order. On receipt of such complaint, the respondent is directed to conduct an enquiry on the complaint and if materials are gathered indicating commission of any cognizable offence, the respondent is directed to proceed further in accordance with law, as early as possible.
6. This criminal original petition is disposed of accordingly.
