This Application has been filed to condone the delay of 863 days in filing the above captioned C.M.A against the decree and judgment passed in MACT.O.P.No.3534 of 2009, dated 21.11.2019 on the file of the V Court of Small Causes, (Motor Accident Claims Tribunal), Chennai. 2.Though notice was served on the 1st respondent/ Transport Corporation, none had appeared on their behalf before this Court. On earlier ocassion Mr.C.Pranthaman, learned counsel has taken notice on behalf of he 2nd respondent, whereas, today when the matter was called for hearing, there was no representation on behalf of the 2nd respondent. 3.Mr.J.Chandran, learned counsel for the 3rd respondent appeared and submitted that he has no objection in allowing the present petition.
4.Heard the learned counsel for the petitioner and the learned counsel for the 3rd respondent.

gba condoned on the condition that the petitioner shall not claim any interest for the period of 863 days, in the event of this Court enhancing the compensation amount.
