Directing the 3rd respondent to consider and to pass appropriate orders based on petitioners representation date at 01/09/2025 requesting to survey and to demarcate the boundaries to the property comprised in survey no 225/17 Situate at Elumichanahalii, GramaNatham, Karimangalam Taluk, Dharmapuri district by cancelling the new FMB sketch issued in name of 8th respondent and to restore the old FMB sketch by including 1950 sqft. Mr.R.P.Murugan Raja Govt.Advocate For R1 to R6 R7 to R8 -Pvt Order This writ petition has been filed seeking for a direction to the third respondent to survey and demarcate the property, which according to the petitioner is owned by him, based on his representation dated 01.09.2025, within a time frame to be fixed by this Court.
2. The petitioner had submitted his representation dated 01.09.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3.Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 to 6. Since no adverse order is being passed against respondents 7 and 8, notice to respondents 7 and 8 is dispensed with.
4.This Court is not expressing any opinion on the merits of the petitioner's representation.
5.No prejudice will be caused to the fourth respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property, morefully described in the prayer to this writ petition, after hearing the objections if any from respondents 7 and 8 as well as any other party whom the fourth respondent deems it fit. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the fourth respondent is directed to issue notice to respondents 7 and 8 and also to any other party, whom the fourth respondent deems it fit to put on notice.
(b) After receiving objections if any and after considering the same, the fourth respondent shall conduct survey and demarcate the boundaries of the property, morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
