This application is filed by the 1st defendant to order reopening the present suit in C.S.No.894 of 2005 for the purpose of hearing the oral arguments on behalf of the 1st defendant.

2. When the matter came up before this Court on 02.02.2024 and 15.02.2024, at the request of both the counsel, the matter was adjourned for filing written arguments. Thereafter, when the matter was taken up for hearing on 27.02.2024, the learned counsel for the plaintiffs had filed their written submissions as well as the convenient set and a copy of the same were also served on the learned counsel for the defendants and the matter was adjourned twice at the request of the learned counsel for the defendants for filing written arguments. Thereafter, when the matter came up before this Court on 12.04.2024, the learned counsel for the plaintiffs, argued the matter and after completion of his argument, the learned counsel for the defendants was not ready to argue the matter. Therefore, after hearing the arguments of the plaintiff, the matter was reserved for judgment. While being so, now the present application has been filed by 1/3

the defendants for re-opening the present suit for hearing oral arguments on the side of the 1st defendant.

Though the reasons stated in the accompanying affidavit is not satisfied, in order to give an opportunity to the 1st defendant to advance their oral arguments, this application is allowed on payment of cost of Rs.25,000/- (Rupees Twenty Five Thousand Only). The said cost has to be paid by the applicant to the credit of the Siddha Clinic, High Court Campus, Chennai, on or before 06.06.2024.
