PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue appropriate direction to the Respondent to file the final report in the case registered in FIR.No.400 of 2018 dated 03.08.2018. O R D E R

This petition has been filed by the de-facto complainant to direct the respondent to file a final report at early in Crime No.400 of 2018.

2.The learned counsel for the petitioner has submitted that the accused person has committed offences punishable under sections 406 and 420 I.P.C and hence the petitioner has lodged a complaint before the respondent, but the respondent has not registered the case. He further submitted that the petitioner has moved this Court by filing a petition in Crl.OP.No.15269 of 2018 and this Court passed an order directing the petitioner to approach the concerned Judicial Magistrate by filing petition under Section 156(3) Cr.P.C. and accordingly the petitioner has filed a petition before the concerned Metropolitan Magistrate under Section 156(3)Cr.P.C and concerned Metropolitan Magistrate, Egmore has directed the respondent to register the FIR and expedite the investigation in the matter. Based on the said direction, the respondent has registered the case in Crime No.400 of 2018, on 03.08.2018, under Sections 406 and 428 IPC. But thereafter, no steps being taken and hence he requests to direct the respondent to expedite the investigation and file final report at early.

3.The learned Public Prosecutor has submitted that the investigation is in progress and final report will be filed within a short time.

4. Considering the above said observations, the respondent is directed to expedite the investigation and file a final report within a period of three months from the date of receipt of a copy of this order.

5. With the aforesaid directions, this Criminal Original Petition is disposed of.
