ORDER

This Writ Petition has been filed to direct the respondents 1 and 3 to take appropriate action based on the petitioners representation dated 03.04.2023 including the departmental proceedings against the 4th and 5th Respondents and further direct them to pay compensation a sum of Rs.5,00,000 /- to the petitioner.

2. According to the petitioner, he was taken to the police station and beaten by the fourth and fifth respondents and he was also treated in the hospital for the injuries sustained by him. In this regard he had given representation to the first respondent and other authorities to take appropriate action against the fourth and fifth respondents. However, no action has been taken by them. Hence, the present Writ Petition.

Whereas, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 on instructions submitted that the representation given by the petitioner itself is an outcome of the First Information Report registered against him on 30.03.2023 on the basis of the complaint given by the defacto complainant.

4. A copy of the First Information Report has also been produced before this Court. Considering the fact that the First Information Report has already been registered against the petitioner on 30.03.2023 and the representation has been given by the petitioner only on 03.04.203 and as the allegation that the

petitioner had been beaten by the respondents itself is disputed, there cannot be any direction to the respondents 1 to 3. If at all the petitioner is aggrieved by the action of the fourth and fifth respondents, the petitioner has to agitate the same before the appropriate forum and not by way of this petition.

5.
