No.707/ 2025/A1 dated 30.08.2025 and quash the same as illegal, violation of law and further direct the respondents to appoint the petitioner as an salesman, with all service benefits within the stipulated time.

ORDER

The petition has been filed to call for the records of the 2nd Respondent

in his Proceedings in Na.Ka. No.707/ 2025/A1 dated 30.08.2025 and quash the same as illegal, violation of law and further, direct the respondents to appoint the petitioner as an salesman, with all service benefits within the stipulated time.

2. When the matter is taken up for hearing, it is brought to the notice of this Court that the very same issue involved in this writ petition has been dealt by this Court in writ petition in W.P.(MD)Nos.22776 and 22777 of 2025 dated 21.08.2025, wherein, it is observed as follows: "5. In view of the above decision and considering the submissions made by the learned counsel for the petitioner, these writ petitions are disposed of with a direction to the concerned respondent to pay subsistence allowance to the petitioner, if not already paid, strictly in accordance with law and further directed to conclude the disciplinary proceedings initiated against the petitioner, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. "

3. The aforesaid common order dated 21.08.2025 squarely applies on all fours to the case in hand and therefore, this writ petition is allowed as prayed for with a direction to the concerned respondent to pay subsistence allowance to the petitioner, if not already paid, strictly in accordance with law and further

directed to conclude the disciplinary proceedings initiated against the petitioner, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
