O R D E R
This Civil Revision Petition is filed by the petitioner seeking to direct the learned Principal Judge, Family Court, Chennai, to dispose of O.S.No.254 of 2012 as expeditiously as possible.
2. The revision petitioner is the first defendant in the suit. The first respondent filed an appeal against the dismissal of the petition filed for restitution of conjugal rights and she has not pursued the appeal. The suit filed by the first respondent / first wife in 2012 prevented the benefits accrued in favour of the revision petitioner. Aggrieved over the long pendency of the suit, the revision petitioner seeks early disposal of the same.
3. From a perusal of the adjudication, it is seen that the matter is posted for defendants' arguments on 22.04.2019.
4. Learned counsel appearing for the petitioner would submit that they have already filed written arguments on 25.02.2019 itself and the Court can pass decree and judgment on the basis of the written arguments submitted by them.
5. Considering the long pendency, this Court is of the considered opinion that a direction can be given to the learned Principal Judge, Family Court, Chennai to dispose of O.S.No.254 of 2012 as expeditiously as possible.
6. Accordingly, the learned Principal Judge, Family Court, Chennai, is directed to dispose of O.S.No.254 of 2012, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.
7. The Civil Revision Petition is disposed of accordingly. No costs.
