O R D E R

This Civil Revision Petition is filed by the petitioner seeking to issue a direction for expeditious disposal of I.A.No.291 of 2018 in O.S.No.176 of 2018, pending on the file of Sub-Court, Perambalur.

2. The petitioner filed a suit for declaration and injunction against the respondents and also filed an application for interim injunction. Originally, the respondents were set exparte and thereafter, the exparte order was set aside and the matter was taken on file. In spite of no objection expressed by the petitioner in allowing the petition filed for setting aside the exparte order, the respondents have not come out with any counter statement and the application for injunction is pending for more than eleven months. Aggrieved over the non disposal of the interim application, the petitioner is before this Court.

3. It is expected that the trial Court, should dispose of the application, particularly the application for interim relief, within a period of one month. However, in the present case, even though the matter is pending for more than eleven months, it is not disposed of.

4. Considering the pendency and the hardship pleaded by the petitioner, this Court is inclined to grant a direction as sought for by the petitioner.

Accordingly, the Sub Judge, Perambalur is directed to dispose of I.A.No.291 of 2018 in O.S.No.17 of 2018 within a period of one month from the date of receipt of a copy of this order.
