Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the second respondent to register the FIR based on the petitioner's complaint in CSR No.539 of 2018 dated 06.08.2018 and to file a final report within the stipulated time.

O R D E R

This petition has been filed to direct the second respondent to register a case, based on the complaint given by the petitioner dated 06.08.2018.

2. The learned counsel for the petitioner has submitted that the accused persons have collected money from the public for the purpose of constructing a temple and subsequently they have mis-appropriated the said money and hence, the petitioner has lodged a complaint before the second respondent on 06.08.2018. On receipt of the said complaint, the second respondent has issued CSR No.539 of 2018 dated 06.08.2018, but, thereafter he has not taken any further action.

3. The learned Additional Public Prosecutor has submitted that the complaint is still pending for enquiry.

4. Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence then, he has to https://hcservices.ecourts.gov.in/hcservices/

register the case and proceed in accordance with law within seven days from the date of receipt of a copy of this order.

5. With the aforesaid directions, this Criminal Original Petition is disposed of.
