JUDGMENT

[JUDGMENT OF THE COURT WAS DELIVERED BY C.T.SELVAM, J] This Civil Miscellaneous Appeal has been preferred against Order and Decreetal order dated 29.03.2012 made in O.P.No.228 of 2009 passed by learned 1st Additional Principal Judge, Family Court at Chennai.

Learned counsel for appellant submits that the appellant/husband has filed O.P.No.228 of 2009 on the file of 1st Additional Principal Court, Chennai, seeking divorce. He would further submit that respondent has obtained an order dated 09.11.2012 granting such relief. Submitting as above, learned counsel seeks permission of this Court to withdraw this appeal and has also made an endorsement to that effect.

3. Recording the said endorsement, the Civil Miscellaneous Appeal is dismissed as withdrawn. No costs.
