Prayer : Writ Petition filed under Article 226 of the Constitute of India praying for Issuance of a Writ of Mandamus directing the 1st respondent to measure petitioner`s property situated in Korattur Village Ambattur taluk comprised in Survey No. 227/1 and 227/2 measuring 62 3/4 cents of Land bounded on the North by J. Balaraman property South by J.Sathya Property East by Kuppammal Land and west by Rajagopal Nadar land measuring North to South on the Eastern side 24.6 meter and Western side 24.9 meter & East to West on the Northern side 102.6 meter and southern side 102.6 meter totally measuring 27359 square feet in pursuant to his application dated 01/06/2020. This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first respondent to act on the application made by the petitioner on 01.06.2020, wherein the petitioner has sought for the survey of the property and for laying the boundary stones.
2. Mr.Parameswaran, learned Government Advocate appearing on behalf of the first respondent submitted that the application made by the petitioner on 01.06.2020 has been taken on file and an enquiry will be conducted by calling the petitioner and the https://hcservices.ecourts.gov.in/hcservices/
second respondent and orders will be passed within the time stipulated by this Court.
3. Taking into consideration the facts and circumstances of the case and the fact that the first respondent has decided to conduct an enquiry, there shall be a direction to the first respondent to take into consideration the application given by the petitioner on 01.06.2020, the representation made by the petitioner on 19.08.2020 and all the relevant documents and pass appropriate orders strictly in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The first respondent shall issue a notice to the second respondent and give an opportunity to the second respondent before conducting the enquiry and passing final orders.
4. This Writ Petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
