Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the second respondent to register a Criminal Case based on the complaint dated 25.11.2017 given by the petitioner which was duly forwarded to the respondents on 29.11.2017.

O R D E R

This petition has been filed to direct the second respondent to register a case, based on the complaint given by the petitioner dated 25.11.2017 which was duly forwarded to the respondents on 29/11/2017.

2. The learned counsel for the petitioner has submitted that the petitioner's wife and his mother-in-law along with five rowdy persons came to the petitioner's house and assaulted him and attempted to commit murder and hence, the petitioner has lodged a complaint before the second respondent, but, no action has been taken and subsequently the petitioner has sent a complaint to the Chief Minister's Cell and the same was forwarded to the first respondent and even thereafter no action has been taken.

3. The learned Additional Public Prosecutor has submitted that the said complaint is still pending for enquiry. https://hcservices.ecourts.gov.in/hcservices/

4. Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, she has to register the case and proceed in accordance with law. In case, the enquiry reveals only a family dispute, then she has to direct the petitioner to approach the appropriate forum and get appropriate relief in accordance with law.

5. With aforesaid directions, this Criminal Original Petition is disposed of.
