ORDER

This Writ Petition has been filed challenging the impugned refusal check slip, dated 30.06.2025 issued by the 2nd respondent, refusing to register the settlement deed, dated 30.06.2025 presented by the petitioner for registration on the following grounds :- (a) the boundaries of the property have not been given by the petitioner;

(b) the original parent document has not been produced by the petitioner.

2. Mr.P.Harish, learned Government Advocate, accepts notice on behalf of the respondents.

3. The petitioner categorically contends before this Court that the executant of the settlement deed is having the legal right to present the settlement deed for registration. He has also traced the title of the property as seen from the avernments contained in the affidavit filed in Page No.2 of 6

support of this writ petition. He has also produced documents along with this writ petition in support of his case that there is no legal impediment for the 2nd respondent to register the settlement deed presented by the petitioner for registration. The petitioner has also challenged the impugned refusal check slip on the ground of violation of the principles of natural justice as no opportunity of hearing was granted to the petitioner by the 2nd respondent before refusing to register the settlement deed presented by the petitioner for registration.

4. This Court is not expressing any opinion on the merits of the respective contentions. However, as seen from the impugned refusal check slip, it is a non-speaking order with regard to the contentions of the petitioner as raised in this writ petition. The impugned order is also an order passed in violation of the principles of natural justice as no opportunity of hearing was granted to the petitioner by the 2nd respondent before issuing the impugned refusal check slip, dated 30.06.2025.

5. Being a non-speaking order with regard to the petitioner's contentions and the supporting documents produced by him and being an Page No.3 of 6

order passed in violation of the principles of natural justice, this Court is of the considered view that the impugned refusal check slip, dated 30.06.2025 issued by the 2nd respondent has to be quashed by this Court and the matter has to be remanded back to the 2nd respondent for fresh consideration on merits and in accordance with law.

Accordingly, the impugned refusal check slip, dated 30.06.2025 issued by the 2nd respondent is hereby quashed by this Court and the matter is remanded back to the 2nd respondent for fresh consideration on merits and in accordance with law. The petitioner shall submit a written explanation to the 2nd respondent, within a period of one (1) week form the date of receipt of a copy of this order, as to why there is no legal impediment for the 2nd respondent to register the settlement deed presented by the petitioner for registration, along with supporting documents. On receipt of the said written explanation within the stipulated time from the petitioner, the 2nd respondent shall take a final decision as to whether the settlement deed, dated 30.06.2025 presented by the petitioner can be registered or not, within a period of three (3) weeks thereafter. In case, the 2nd respondent decides to refuse registration of the Page No.4 of 6

settlement deed presented by the petitioner, the 2nd respondent shall pass a speaking order with regard to the written explanation submitted by the petitioner as well as the supporting documents produced by him.
