BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.7639 of 2022 CRL.R.C.NO.545 of 2022 AGAMADOU IBRAGUIME SHUAID [ PETITIONER / APPELLANT / ACCUSED ] SIRADJ TRADERS Vs BRAVO LOGISTICS PRIVATE LIMITED, [ RESPONDENT / COMPLAINANT ] REP BY ITS MANAGER DIRECTOR, MADHAN KUMAR Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Extend the time granted in order dated 29.04.2022 in Crl.MP.5543/2022 on the file of this Hon'ble Court for depositing the compensation amount and pass such or other suitable and appropriate orders.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S S.SANTHOSH KUMAR, Advocate for the petitioner the court made the following order:- By order dated 29.04.2022, this Court, while granting suspension of sentence, imposed the condition that the petitioner shall deposit 30% of the cheque amount being Rs.13,12,019.40 to the credit of C.C. No. 6549 of 2017 on the file of learned Metropolitan Magistrate, Fast Track No.I, Allikulam, Chennai. Since four weeks time granted to deposit the amount has expired, this petition is moved seeking extension of time.

Learned counsel for the petitioner prays that if six weeks time is granted, the petitioner would deposit the amount as directed by this Court.

Considering the facts and circumstances of the case, six weeks time is granted to the petitioner from today to comply with the conditional order passed by this Court.

It is made clear that no further extension of time will be granted.

If the petitioner fails to deposit the amount within the time prayed for and granted by this Court, the order suspending the sentence of the petitioner shall stand automatically vacated. The respondent Police as well as the Trial Court are at liberty to proceed further to issue warrant and commit the petitioner to prison to make him serve the sentence pending revision.
