The petitioner, who was arrested and remanded to judicial custody on 20.02.2024 for the alleged offence under Sections 341, 323, 302, 506(ii) r/w 34 of I.P.C. in Crime No.15 of 2024 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 19.02.2024 around 02.00 p.m., one Surya called the defacto complainant over phone and informed that while his brother and his friend going on his bike, the petitioner along with other accused waylaid them and when he tried to escape, they attacked deceased with knife and sickle and also threatened his friend with dire consequences, thereby deceased sustained multiple injury all over the body and subsequently died. Hence, the defacto complainant lodged the present complaint against the petitioner.

The learned counsel appearing for petitioner would submit that he has not at all committed any offence as alleged by him and he is no way connected with the alleged occurrence and there is no specific overtact attributed against him. He would submit that investigation is almost completed and he is ready to comply with the condition imposed by this court. He would also submit that the petitioner has been suffering incarceration for 68 days from 20.02.2024. Hence, he prays to grant bail to the petitioners.

The learned Public Prosecutor (Pudy.) appearing for respondent would submit that totally there are 4 accused involved in this case, in which the petitioner is arrayed as A3 and all the accused names were mentioned in the F.I.R. He would submit that all the accused were arrested on 20.02.2024 and the investigation is not yet completed. He would submit that if he is released on bail, he would hamper investigation and tamper the witnesses. Hence, he vehemently opposed to grant bail to the petitioner.

Considering the above facts and circumstances and according to the prosecution, due to previous enmity of quarrel happened between the accused, the petitioner along with other accused have assaulted him with knife and sickle, in which he sustained multiple injuries all over the body and subsequently, he died and on seeing the gravity of offence committed by the petitioner and the fact that the investigation is not yet completed and so, at this stage, if he is released on bail, he may abscond and there is possibility of tampering evidence and hampering investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
