Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Declaration, to declare Rule 8(3A) of Central Excise Rules, 2002 as ultra vires of the object and scope of Central Excise Act and the CENVAT scheme and ultra vires of Explanation to Rule 8(4) of the said rules and contrary to the instructions of the Central Board of Excise and Customs in their CBEC Manual.
