..Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance a Writ of Certiorarified Mandamus to call for the records relating to the order passed by the third respondent dated 31.07.2015 in his order No.PITAM/ADMIN/IT/2008-2012/2015, and quash the same and direct the respondents to alter the date of birth of the petitioner as 19.06.1990 according to the Birth Certificate issued by the Commissioner, Virudhachalam Municipality and issue fresh Transfer Certificate.

ORDER

Challenging the order dated 31.07.2015 passed by the third respondent, the request of the petitioner to change the date of birth in the college records had been rejected on the ground that the date of birth in the college records has been entered based on the date of birth mentioned in the S.S.L.C. Certificate, H.S.C. Certificate and H.S.C. Transfer Certificate as 16.06.1990. https://hcservices.ecourts.gov.in/hcservices/

The learned counsel appearing for the petitioner submitted that the date of birth mentioned in the Birth Certificate of the petitioner is different from the one entered in the School Certificates and the same ought to have been accepted by the respondents. This Court is not inclined to accept the said submission.

3. In any event, the entry of date of birth has been made only based on the School Certificates of the petitioner. There is no mandate in law that the respondents are duty bound to make the corrections in the college records based on the Birth Certificate. In any case, the Birth Certificate is a piece of evidence showing the date of birth. Therefore, the writ petition stands disposed of, with liberty to the petitioner to take appropriate steps in the manner known to law to change the S.S.L.C., H.S.C. as well as H.S.C. Transfer Certificate, if she is so advised. If the necessary certificates are changed with respect to the date of birth, then the third respondent will have to change the entry made in the college records based upon the same. No costs. Consequently, the connected Miscellaneous Petition is closed.
