(S) M. Meera v. Shri P.Narasimman
TR.CMP.No.435 of 2015 and M.P.No.1 of 2015 N.KIRUBAKARAN, J This Court, in the Transfer Petition filed by the petitioner, granted a decree dated 05.08.2016, declaring the marriage held on 13.11.2014 between the petitioner and the respondent is null and void on the ground of fraud and suppression of preexisting disease of the respondent/husband. However, by mistake, in the Original Transfer Petition itself, the initial of the petitioner has been wrongly described and mentioned as "S", whereas her initial is "M" viz., M.Meera. Only when the order copy is made ready, the said mistake was noted by the petitioner and therefore, this Transfer Petition is brought before this Court at the instance of the petitioner under the heading "for being mentioned" to rectify the mistake and to issue a fresh order copy.
2. Today, when the matter is taken up for hearing, an affidavit has been filed before this Court only to correct the mistake in the initial of the petitioner in the order copy. Paragraph No.4 of the affidavit is extracted hereunder: "4. I submit that in the order copy, my initial has been given as "S". I have described as S.Meera. Actually, my father's name is Murali. Hence, my initial should have been "M". That is, I should have been described as M.Meera".
3. Even though the matter has been listed by printing the name of the counsel for the respondent and the copy of the above affidavit has also been served on the counsel for the respondent, no one appeared on behalf of the respondent. Therefore, this Court passes the following order:-
N.KIRUBAKARAN.J., rg
4. Since the petitioner is the daughter of S.Murali, her name should be described only M.Meera. In view of the same, Office is directed to substitute wherever the initial of the petitioner "S" comes in the order dated 05.08.2016 with "M" and issue a fresh order copy.
