O R D E R
The present criminal original petition has been filed seeking a direction to the respondents police to register a case on the basis of the complaint given by the petitioner dated 28.10.2015. 2.The petitioner lodged a complaint on 28.10.2015 before the first respondent police against one Jahangir and Mallamma on the allegation of land grabbing. Since no action was taken so far, he has come forward with the present criminal original petition. 3.The learned Additional Public Prosecutor submitted that the complaint was sent only by post and if a direction is given to the petitioner to give a fresh complaint to the Inspector of Police, District Crime Branch, Krishnagiri, necessary action would be taken. https://hcservices.ecourts.gov.in/hcservices/
4.I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
5.Considering the submissions made on either side, this Court directs the petitioner to submit a fresh copy of the complaint dated 28.10.2015 along with a copy of this order to the Inspector of Police, District Crime Branch, Krishnagiri and on receipt of the same, the Inspector of Police, District Crime Branch, Krishnagiri is directed to enquire the matter and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law as early as possible, preferably, within a period of two weeks, from the date of receipt of a copy of the complaint. If no prima facie case has been made out, the Inspector of Police, District Crime Branch, Krishnagiri is at liberty to pass appropriate order on the complaint given by the petitioner.
