O R D E R

This writ petition has been filed seeking for issuance of a writ of mandamus to direct the respondents-Police to remove the petitioner's name from History Sheet / Rowdy list concerned in H.S.No.261/19 on the file of the third respondent herein.

According to the petitioner, he was falsely implicated as an accused by the third respondent in Crime No.903 of 2020 for the offences under Sections 341, 147, 148, 294(b), 323, 324 and 506(2) IPC read with Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 1998 and later he was acquitted from the said case vide order dated 13.07.2022 in C.C.No.17 of 2021 on the file of the Judicial Magistrate No.I, Jayankondam. Thereafter, again, he was falsely implicated as an accused in Crime No.24 of 2023 for the offences punishable under Sections 387 and 506(2) IPC by Pg.Nos.2/6

the third respondent and the petitioner was acquitted by the learned Judicial Magistrate No.I, Jayankondam on 16.02.2024 in C.C.No.109 of 2023. Thereafter, no criminal case has been registered or pending against the petitioner. However, the third respondent herein open the history sheet in the name of the petitioner vide H.S.No.261/19. It is further submitted that the petitioner has not involved in any rowdy element and he was falsely implicated in the above said cases. Hence, the petitioner has made several representations to the respondents to remove his name from the History Sheet/Rowdy list, but the same was not considered so far. Hence, the petitioner has come forward with the present petition.

Learned Government Advocate (Crl.Side) appearing for the respondents-Police on instructions, submitted that totally 7 cases have been registered against the petitioners, out of which, he was acquitted from two cases and two cases were registered during Covid-19 pandemic period and in other cases, he is facing trial and that H.S.No.261/19 was opened against the petitioner and it is still maintained by the third respondent police. He further submitted that in order to maintain peace among the locality and also Pg.Nos.3/6

to maintain smooth law and order situation, this Court permitted the respondents/Police to maintain H.S.No.261/19 against the petitioner/accused.

4.. Taking into consideration the facts and circumstances of the case and the antecedents of the petitioner, this Court is not inclined to grant the relief as sought for by the petition in the writ petition.
