ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 109 and 351(3) of BNS 2023, in Crime No.110 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, along with other accused, brutally attacked the de facto complainant's brother with a knife, abused him in filthy language, threatened him, and caused grievous injuries. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has no previous cases, and that he has been implicated in this case merely on suspicion. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4. At this juncture, the learned Government Advocate (Criminal Side) appearing for the respondent police strongly opposed this petition on the ground that A1, A2, and A6 have already been remanded to judicial custody, and that this petitioner, who is arrayed as A3, has actively participated in the offence. He further submitted that the investigation is at a nascent stage.

5. Heard the learned counsel on either side and perused the materials available on record.

Taking into consideration the seriousness of the allegations against the petitioner, the severity of the overt act attributed to him, and the fact that the investigation is still at a nascent stage, this Court finds that the submission made by the learned Government Advocate (Criminal Side) regarding the necessity of custodial interrogation cannot be faulted. Hence, this Court does not find any merit in this application. Accordingly, this Criminal Original Petition is dismissed.
