ORDER

This writ petition has been filed seeking for a direction to the respondents to consider the petitioner's representation dated 19.02.2026 within a time frame to be fixed by this Court.

2. As seen from the affidavit filed in support of the writ petition, the petitioner had sold a land, which was the subject matter of land acquisition, to a third party. The said third party had also filed a civil suit against the petitioner for refund of the sale consideration from the petitioner. The petitioner has given a representation on 19.02.2026 to the respondents requesting the respondents to pay the compensation amount to the petitioner on the ground that he may not succeed in the suit filed by the third party, who had paid the sale consideration for the purchase of the very same property from the petitioner. Such a representation is not maintainable and cannot be entertained by this Court.

When the land is the subject matter of acquisition, the petitioner ought not to have entered into a sale agreement or executed a sale deed in favour of a third party involving the very same property. There must be a statutory right for the petitioner to claim compensation amount from the respondents for the lands acquired by them from the petitioner. When the petitioner had already sold the property to a third party during the acquisition proceedings and the said third party has also filed a civil suit subsequent to the sale seeking for refund of sale consideration from the petitioner, this Court is of the view that this writ petition is not maintainable. There is no locus standi for the petitioner to now submit a representation to the respondents seeking for payment of compensation in respect of the acquired lands.

For the foregoing reasons, this Court does not find any merit in this writ petition. Accordingly, this writ petition is dismissed.
