The petitioner, who was arrested and remanded to judicial custody on 03.03.2024 in Crime No.29 of 2024 registered under 174(3) Cr.P.C and later altered for the alleged offences punishable under Section 306 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is none other than the husband of the victim/deceased and he has not abetted the victim to commit suicide. He further submitted that the petitioner is suffering incarceration from 03.03.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail stating that the petitioner, who is the husband of the victim/deceased, was having an illegal intimacy with his victim's younger sister and on coming to know about the same, the petitioner's wife/victim has committed suicide by consuming rat paste. https://www.mhc.tn.gov.in/judis

4. He further submitted that RDO report is awaiting and this case needs a detailed investigation and therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further investigation.

5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and considering the nature and gravity of the offence committed by the accused and taking note of the fact that this case needs a detailed investigation, this Court is not inclined to grant bail to the petitioner.
