This miscellaneous petition has been filed to condone the delay of 42 days in filing the above CMA.

2. Heard the learned counsel for the petitioner. Though notice served on the respondent and his name being printed in the cause list, there is no representation for him either in person or through counsel.

3. Considering the submissions made by the learned counsel for the petitioner and on being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this Court is inclined to condone the delay of 42 days in filing the above CMA,

4. Accordingly, the delay is condoned and the petition stands allowed.
