JUDGMENT

Challenging the concurrent finding of the Courts below, the second defendant has filed the present Second Appeal.

2. This Court, by an Order 29.01.2026, referred this matter to mediation. When the matter is taken up today, the learned counsel appearing for both sides submitted that the dispute between the parties has been settled before the mediator and a settlement agreement was entered between the parties before the Mediator in which both the parties have signed and the same has been sent to this Court along with a report of the mediator.

3. Accordingly, this Second Appeal is disposed of in terms of Settlement Agreement entered between the parties before the Mediator. The settlement Agreement entered between the parties before the Mediator dated 05.02.2026 shall form part of the decree. No costs.
