Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.A.V.SOMASUNDARAM, Advocate for the petitioner and of Mr.K.
SRINIVASAN, SPECIAL PUBLIC PROSECUTOR FOR CBI CASES, on behalf of the Respondent the court made the following order:- The above petition is filed praying to modify the condition imposed upon the petitioner on 10.06.2016 in Crl.MP.No.6214 of 2016 in Crl.A.No.411 of 2016 to relax the condition of the appearance of the petitioner on the first working day of every month at 10.30 a.m. before the XI Special Judge for CBI Cases (Banks and Financial Institutions), Chennai, pending disposal of the above appeal in Crl.Appeal No.411 of 2016.
2. It is submitted by the learned counsel for the petitioner that the petitioner is a senior citizen and he is suffering from age related medical problems, and he is also a permanent residents of Bangalore, so he finds difficult to travel from Bangalore to Chennai every month.
3. Learned Special Public Prosecutor appearing for the respondent submits that the petitioner has been complying with the conditions imposed by this court without any default.
4. In the circumstances, this court is inclined to modify the order dated 10.06.2016 passed in Crl.M.P.No.6214 of 2016 in
Crl.A.No.411 of 2016. Accordingly, the petitioner shall appear before the XI Special Judge for CBI Cases (Banks and Financial Institutions), Chennai at 10.30 a.m., on the first working day, once in three months, pending appeal.
