ORDER

The present Writ Petition has been filed seeking a direction to the respondent to deposit the award amount passed in W.C. No.23 of 2016 dated 22.12.2025 on the file of the Joint Commissioner, Labour, Vellore.

2. Since no adverse order is being passed against the respondent, notice to the respondent is dispensed with.

3. The petitioner filed a claim petition before the Commissioner of labour under Workmen Compensation Act claiming compensation of Rs.6,00,000/- in W.C.No.23 of 2018 at Vellore towards the injuries sustained by her in a fire accident during the course of her employment at Sri Sonali Match Jon Works at Gudiyatham Town. The said petition, after an elaborate adjudication, was allowed in favour of the petitioner on 22.12.2025 directing the respondent to pay a sum of Rs.4,15,022/- as compensation to the petitioner along with 12% simple interest . It is her grievance that, till date, the said order has not been implemented by the respondent. Hence, the present Writ Petition. 4.Learned counsel for the petitioner would submit that, though the award was passed as early as on 22.12.2025, till date, the respondent has not come forward to implement the same and therefore, he prayed this Court for passing appropriate orders.

5.At the outset, this Court is of the view that the prayer in this writ petition is misconceived. If the petitioner is aggrieved over the nonimplementation of the orders of the Labour Court, the remedy available to her is to file Execution Petition before the Court concerned, but not a writ petition seeking mandamus to implement the order of Labour Court. Therefore, the writ petition is not maintainable.

6. Accordingly, this writ petition stands disposed of with liberty to the petitioner to file the Execution Petition before the appropriate court. There shall be no order as to costs.
