ORDER
The prayer of the petitioner is for a mandamus simplicitor directing respondents 1 to 3 to change the name in which the Electricity Service Connection numbers 041-036-502, 041-036-503, 041-036-504, 041-036505, 014-036-710 & 041-036-711 (electricity connections) from the fourth respondent's name to his own name. In light of the order proposed to be passed now, no notice is issued to the fourth respondent. To be noted that, interest of R4 is protected by virtue of this order. 2.
A perusal of the writ affidavit would reveal several factual aspects of the matter that would have to be taken note of, prior to consideration of the petitioner's plea. The electricity connections relate to the property at Survey No. 211/1, Manali Village. Petitioner has furnished various details in regard to the ownership and possession of that property. It is evident that there are disputes qua petitioner and fourth respondent in this regard. In such circumstances, it would be inappropriate for consideration of the prayer of the petitioner for change of name of the said electricity connection per se.
3. In fact, the petitioner himself made a request before the authority seeking similar relief on 16.04.2024 and that request is stated to be pending. In such circumstances, it would suffice to direct the third respondent / Assistant Engineer (O.M.) MES (North), Manali, Chennai, to consider representation dated 16.04.2024, hear the petitioner, R4 and any other person thought necessary and pass orders orders on the representation aforesaid within a period of six weeks from the date of 2/4
receipt of a copy of this order.
