O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 420 of IPC, in Crime No.13 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the other accused approach the defacto complainant and induced stating that they would transfer the foreign currency into Indian currency, believing their words the defacto complainant paid a sum of Rs.1,00,00,000/- on various occasion. Thereafter, they have not repaid the amount and thereby, they cheated the defacto complainant. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that a false case has been foisted against him. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner is the main accused in this case and further submit that the investigation is still pending. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration the allegations and the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is very much essential, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
