Challenging the impugned order 005/2024/A4 dated 03.01.2025 of the second respondent rejecting the claim of the petitioner on the issue of legal heir certificate, the present Writ Petition has been filed. Further, the petitioner has sought for a direction to the second respondent to issue the legal heir certificate to the petitioner vide application No.TN 7202407031734 dated 03.07.2024 i.r.o. the unmarried young brother Late G. Thiyagarajan, who died intestate on 17.04.2024.

The learned counsel for the petitioner (P-In-P) submitted that the petitioner is the brother of the deceased Thiyagarajan, who was unmarried and died intestate on 17.04.2024 leaving behind some deposits. Thereafter, he applied for issuance of legal heir certificate and on verification, the petitioner was directed to produce the adoption deed of his elder brother Mohan for which he produced Aadhaar Card and his death certificate which
has his adoptive parents' name of Late Mohan which were not considered. He contended that in family settlement, adoption deed is not mandatory and also that the registration of adoption deed was non existent as on 1965. Hence, he addressed the said issue to the CM's Grievance Cell on 25.08.2024 but without considering the aforesaid documents, they returned the application with the direction to furnish the necessary documents sought for, to the second respondent. Aggrieved by the same, the present Writ Petition has been filed.

Admittedly, the application sent to the CM's Grievance Cell has been returned to the petitioner with a direction to furnish the necessary documents to the second respondent but instead of complying the same, the petitioner has approached this Court by way of filing the present Petition. In view of the same, this Court is not inclined to grant the relief sought for by the petitioner in this Writ Petition and accordingly, the Writ Petition stands dismissed. However, the petitioner is at liberty to approach to the second respondent with the relevant documents so as to prove his entitlement for issuance of the legal heir certificate and the second respondent shall pass appropriate orders on the said issue taking into consideration of the order passed in G.O.(Ms) No.110, Revenue and Disaster Management, Revenue
Administration Wing, RA-3(2) Section, dated 13.03.2024.
5. With the above directions, this Writ Petition stands dismissed. There shall be no orders as to costs.
