C.M.P.No.10798 of 2023 in C.M.A.SR.No.725 of 2023 SUNDER MOHAN,J.

This petition has been filed to condone the delay of 123 days in filing the above captioned C.M.A.

2. M/s.V.Pushpa, the learned counsel appearing for the petitioner submitted that the second respondent remained exparte before the Tribunal and the second respondent is no more. Hence, notice to the legal representative of the deceased/second respondent may be dispensed with.

3. In view of the submission made by the learned counsel for the petitioner, notice to the legal representative of the deceased/second respondent is dispensed with.

4. Though notice has been served on the first respondent, none has entered appearance on behalf of him.

5. Since I am satisfied with the reasons stated in the affidavit filed in support of this application, the delay is condoned. Hence, this petition is ordered as prayed for.

6. Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
