Prayer : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to grant permission to lay underground pipeline for irrigation purpose from Muliyanur Panchayat Road upto the petitioner's agricultural land through Survey Nos.331 and 332 1/5
of Kannappalli Village, Anthiyur Taluk, Erode District, to the legnth of 500 meters approximately by considering the petitioner's representation dated 24.02.2025 within a tie frame.

ORDER
This Writ Petition is filed with the prayer directing the respondents to grant permission to lay underground pipeline for irrigation purpose from Muliyanur Panchayat road upto the petitioner's agricultural land through Survey Nos.331 and 332 of Kannapalli Village, Anthiyur Taluk, Erode District to the length of about 500 metres approximately by considering the petitioner's representation dated 24.02.2025. 2/5

Mr.C.Munusamy, the learned counsel for the petitioner taking this Court through G.O.Ms.No.75 dated 25.02.2021 would submit that the petitioner is requesting permission to take water for the irrigation of his own land the same is permissible as per the aforementioned Government Order. The learned counsel would also submit that already proceedings in br/K/f/vz;/915-2024-,tm2 dated 15.02.2024 is also issued in this regard. Therefore the petitioner had made the representation.
3. When the matter came up for admission, Mr.V.Monoharan, learned Additional Government Pleader would submit that even without the permission the petitioner started work and now he has applied for permission.
4. I have considered the rival submissions that are made.
5. In view of the limited relief that is granted, this Writ Petition is disposed of at the admission stage. Without disqualifying the petitioner for starting the work without permission, the prayer for permission shall be considered in accordance with rules and law. The petitioner's representation 3/5
dated 24.02.2025 shall be taken up for consideration and the second respondent shall also issue notice to the petitioner, hear the petitioner and decide the matter in accordance with the aforementioned Government Orders and any other Rule that is applicable. The said exercise shall be completed within a period of 8 weeks from the date of receipt of the web copy of the order, without waiting for the certified copy of the order. Needless to mention that if any charges have to pay the same shall also be paid by the petitioner. No costs.
