PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the respondent to release and handover the vehicle bearing Registration No.TN-21-AM-0055 (Etios Car) to the petitioner which are in the unlawful custody of the respondent police by virtue of Crime No.1127 of 2020. For Petitioner : M/s Rayeesa Fathima For Respondent : Mr.S.Karthikeyan Additional Public Prosecutor.

O R D E R

The Criminal Original Petition has been filed to direct the respondent to release and handover the vehicle bearing Registration No.TN-21-AM-0055 (Etios Car) to the petitioner which are in the unlawful custody of the respondent police by virtue of Crime No.1127 of 2020.

2.The learned Additional Public Prosecutor would submit that the vehicle bearing registration No.No.TN-21-AM-0055 (Etios Car) is involved in the Crime No.1127 of 2020 registered for the offence under Sections 406 and 420 of IPC, on the file of the respondent police. Immediately after seizure of vehicle, in pursuant to the Crime No.1127 of 2020, it was produced before the Court concerned in C.P.No.66 of 2020.

3.Therefore, considering the above submission made by the learned Additional Public Prosecutor, the direction sought for in the petition cannot be granted. However the petitioner is at liberty to file a fresh petition before the Court concerned, for return of property, in the manner known to law. 4.Accordingly the Criminal Original Petition is disposed of.
