Application Nos.2360 and 2361 of 2026 in CS DR No.154113 of 2025 MASTER 12.06.2026 COMMON ORDER
1. There are two applications filed by the applicant. A.No.2360 of 2026 is filed to condone the delay of 90 days in payment of deficit court fee and the reason for the same is that due to inadvertence there occurred a bona fide calculation error at the time of filing which was not intentional. A.No.2361 of 2026 is filed to condone the delay of 60 days in representation of the suit and the reason stated for the delay is that it took sometime to correct the necessary documents which are required to rectify the return compliance.
2. The delay is only in refiling and not in filing. This court has come across many number of Judgment wherein the Hon'ble High Court has taken a lenient view in condoning the delay in representation.
3. Following the same analogy and also considering the fact that substantial court fee has already been paid in this case. This court is inclined to allow these applications.
