ORDER
(Order of the Court was made by Sunder Mohan J.) The wife of the convict prisoner has filed this writ petition challenging the rejection of the request for ordinary leave for her husband. 2.Learned counsel for the petitioner would submit that the presence of the convict prisoner is required to arrange the marriage of the petitioner's son, who is aged about 32 years and that the impugned order has been passed only because the petitioner was unable to produce any documents to substantiate his request.
3.The learned counsel for Government of Tamil Nadu (Criminal Side) submitted that the Probation Officer found the reason stated for grant of leave to
be false and hence had not recommended for leave. He would fairly submit that the petitioner has undergone 4 years and 9 months in prison out of 7 years of sentence awarded to him and that he was already granted ordinary leave by an order of this Court in WP.No.580 of 2025 dated 27.01.2025. 4.The convict prisoner is otherwise eligible for leave. The reason stated by the petitioner is she along with her husband have to make arrangements to get the petitioner's son married. There cannot be any document to substantiate the said claim.
5.Therefore we are inclined to grant ordinary leave for a period of 28 days commencing from 06.06.2026.
6. (i) The respondents are directed to release the convict viz., Perumal, S/o. Annamalai, aged about 62 years, confined at Central Prison-I, Puzhal, Chennai, on ordinary leave for a period of twenty eight (28) days without escort i.e., from 06.06.2026 to 03.07.2026.
(ii)The convict shall be released on 06.06.2026 at 10.00 A.M. and is directed to surrender before the Superintendent of Prisons, Central Prison-I, Puzhal, Chennai, on 04.07.2026 before 10.00 A.M.
(iii)The convict shall report before the Chitlapakkam Police Station, once in a week, i.e., on every Monday at 10.30 A.M, during the period of leave. (iv)During the leave period, the Convict Prisoner shall abide by all the conditions prescribed in the Jail Manual.
