Petition filed seeking to transfer the investigation of Crime No. 8 of 2013, on the file of third respondent to fourth respondent and subsequently direct the fourth respondent to depute a competent officer to take up the case.

2. Heard learned counsel for petitioner and learned Government Advocate (Puducherry).

3. Learned Public Prosecutor (Puducherry) submits that the case in Crime No.8/2013 on the file of third respondent, transfer of which is sought by way of this petition, has resulted in filing of positive final report. However, the petitioner is not arrayed as an accused.

In the circumstances, this Court recording the above submission would dismiss the present petition. The Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is also dismissed. 05.06.2017 Index: Yes / No Internet: Yes gm/bri
