Prayer: The Civil Revision Petition filed under Article 227 of Constitution of India, to direct the Principal District Judge, Vellore to number the plaint filed in O.S.SR.No.707 of 2024, within a time frame fixed by this Court. For Petitioner : Mr.M.R.Thangavel

ORDER

The Civil Revision Petition has been filed to direct the Principal District Judge, Vellore to number the plaint filed in O.S.SR.No.707 of 2024. 2.Heard the learned counsel for the petitioner. 3.The learned counsel for the petitioner states that the suit has been repeatedly returned by the Principal District Judge, Vellore, despite the compliances made being in the nature of curing the returns. The learned counsel for the petitioner would take me through the returns right from 26.06.2024 and the last return on 18.02.2025, addressing the returns 3 and 4 are only formal returns which can be cured by the petitioner. Insofar as the 1st return, the learned counsel for the petitioner states that the custody of the Doc.No.6 has already been clearly mentioned in the earlier return, stating 2/4

that the resolution copy is not available and the plaintiff has also undertaken to provide the same at the time of trial.

4.With regard to Section 92 of CPC application, the learned counsel for the petitioner states that the petition was already filed along with the plaint, however, the Registry has misplaced the same and the petitioner is willing to file a fresh application. With regard to the latest return dated 18.02.2025, if the plaintiff is able to comply with the returns by filing fresh Section 92 petition and is complying with 3 and 4, the suit may be numbered and taken on file. Time for representation for the original plaint is eight weeks and the Registry shall return the original plaint to the learned counsel for the petitioner, after getting an acknowledgment. 5.With the above direction, the Civil Revision Petition is allowed. There shall be no order as to costs.
