O R D E R

The petitioner/wife has filed the above Transfer Civil Miscellaneous Petition to withdraw H.M.O.P.No.43 of 2012 pending on the file of the Sub Judge, Thiruthani, Thiruvallur District and transfer the same to the file of the Family Court, Chennai. 2.

It is stated that the respondent-husband did not maintain the petitioner-wife and the child and hence she has filed M.C.No.331 of 2015 before the Family Court, Chennai and also H.M.O.P.No.1593 of 2015 before the II Additional Family Court, Chennai for re-union with the respondent-husband. 3.

The respondent-husband has filed divorce petition before the Sub Court, Thiruthani in H.M.O.P.No.43 of 2012. The petitioner is residing in Chennai and the child is also studying in Chennai. She has to travel more than three hours from Chennai to reach Thiruthani for every hearing of the case. The respondent-husband is also working in Chennai. Hence, she prays for transfer.

4. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the materials available on record.

Taking into consideration of the above grievance of the petitioner, this Tr.C.M.P is allowed and the H.M.O.P.No.43 of 2012 from the file of the Sub Court, Thiruthani shall stand withdrawn and is transferred to the Family Court, Chennai to be tried along with H.M.O.P.No.1593 of 2015 and M.C.No.331 of 2015. No costs. Consequently, connected miscellaneous petition is closed.
