Respondent/Complainant Prayer :- Criminal Revision Petition filed under Section 397 r/w 401 of Cr.P.C. to call for the records relating to CA.No.6/2014 dt. 8.3.2016 on the file of II Additional Sessions Judge, Pondicherry together with the records in Cr.MP.NO.6000/2013 in MC.No.27/2013 on the file of Judicial Magistrate No.II, Pondicherry and set aside the same.

ORDER

The criminal revision petition is directed against the order passed by the learned II Additional Sessions Judge, Pondicherry in CA.No.6 of 2014 dated 08.03.2016 confirming the order passed by the learned Judicial Magistrate No.II, Pondicherry in Cr.MP.No.6000 of 2013 in MC.No.27 of 2013 dated 28.01.2014. 2.Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3.The learned counsel for the petitioner is ready to cooperate with the trial and the main case may be disposed of within the stipulated time fixed by this Court and ready to deposit the entire interim maintenance amount before the trial Court till the disposal of the main case.

4.The learned counsel for the respondent also agreed to cooperate with the trial and he also submits that the main case may be directed to be disposed of within a period of one month. 5.This court records the submission made by the learned https://hcservices.ecourts.gov.in/hcservices/

counsel appearing on both sides and both the counsels fairly admitted to cooperate with the trial Court to dispose of the main case.

6.In view of the above said circumstances, this Court is of the considered view to dispose of the revision petition with the following conditions :-

1. The petitioner is directed to deposit the entire arrears of interim maintenance and monthly maintenance amount to credit of MC.No.27 of 2013 on the file of Judicial Magistrate No.II, Puducherry, till the disposal of the main case.

2. Both the parties are directed to co-operate before the trial Court to dispose of the main case.

3. The learned Judicial Magistrate No.II, Puducherry is directed to dispose of the main case within a period of two months from the date of receipt of a copy of this order.

4. At the time of pronouncing order, the learned Judicial Magistrate No.II, Puducherry is further directed to pass an specific order regarding the amount deposited in to the credit of MC.No.27 of 2013.

7.With the above observation, the criminal revision is disposed of. Consequently, connected miscellaneous petition is closed.
