PRAYER: Tr.C.M.P. filed under Section 24 of C.P.C., to withdraw the case in D.O.P.No.117 of 2012 pending on the file of learned District and Sessions Judge, Villupuram and transfer the same to the learned District and Sessions Court, Cuddalore.

Heard the learned counsel for the petitioner. None appears for the respondent in spite of printing her name in the cause list after service.
2. The petitioner preferred proceedings in D.O.P.No.117 of 2012 before the District and Sessions Court, Villupuram against the respondent. The petitioner, who is stated to be a practising Advocate at Villupuram has come up with this transfer petition.
3. It is the case of the petitioner that being a practising Advocate at District and Sessions Court, Villupuram, it would be difficult for him to prosecute the proceedings before the said Court. The respondent is stated to be a Teacher working at Villupuram. According to the petitioner, he has to conduct the proceedings before the Court, where, he is practising. According to him, it gives mental agony on each day as he has to wait for his turn to appear in D.O.P.No.117 of 2012 before the District and Sessions Court, Villupuram.
4. There is nothing on record to suspect the bonafides in filing this transfer petition. I am therefore of the view that the transfer petition deserves to be allowed.
5. The proceedings in D.O.P.No.117 of 2012 is withdrawn from the file of District and Sessions Court, Villupuram and is transferred to the file of District and Sessions Court, Cuddalore for disposal on merits.
