O R D E R

The present petition has been filed seeking a direction to the respondent to register a case based on the complaint given by the petitioner dated 06.10.2015.

2. The petitioner herein lodged a complaint against one Suriyanarayan and Arunkumar alleging that they misrepresented the petitioner that they have lands in Ramanathapuram- Trichy Road for sale and took the petitioner to the spot. It was also represented by them that owner of the property gave Power of Attorney to them to sell the said land and have also shown some documents to the petitioner. Believing the said representation, the petitioner agreed to purchase the land for a sum of

Rs.1,01,01,040/- and paid a sum of Rs.96 lakhs. Later, the petitioner came to know that the said Power of Attorney is a created document. Hence, the petitioner lodged a complaint dated 06.10.2015 and since no action was taken by the respondent police, the petitioner came forward to file this petition. 3.Today, when the matter is taken up for consideration, the learned Additional Public Prosecutor submitted that since the amount involved is more than Rs.25 Lakhs, the petitioner ought to have lodged the complaint before the Central Crime Branch, Coimbatore since the respondent has no power to investigate the case.

4. In view of the submission made by the learned Additional Public Prosecutor, the respondent is directed to transfer the complaint to Central Crime Branch, Coimbatore and the Central Crime Branch, Coimbatore is directed to investigate the case and upon enquiry, if materials are gathered indicating commission of any cognizable offence, the Central Crime Branch is directed to proceed further in accordance with law, as early as possible.
