O R D E R
(The case has been heard through video conference) This Criminal Original Petition has been filed by the petitioners to enlarge them on interim / transit anticipatory bail in the event of arrest by the respondent in Crime No. Not Known on the file of the 1st respondent police.
2. The learned counsel for the petitioners would submit that a false complaint has been given against the petitioners and they have nothing to do with the said allegations.He further submitted that Interstate Anticipatory bail may be granted to them to enable them to move the appropriate jurisdictional Court for necessary relief.
3. The learned Additional Public Prosecutor on instructions would submit that the 2nd respondent has no intention to arrest the petitioner, however, on instructions he would submit that there is a case pending against the petitioner before the first respondent police station.
4. Taking into consideration that there is no apprehension of arrest by the 2nd respondent, this Court is inclined to grant inter-state interim anticipatory bail to the petitioner.
5. The interim interstate anticipatory bail is granted to the petitioners for a period of four weeks ie., til 16.10.2020, on condition that the petitioner shall surrender before the learned XVII Metropolitan Magistrate, Saidapet,Chennai, within a period of fifteen days from the date on which the order copy is made ready and the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within two weeks from the date of execution of bail bond, the petitioners shall approach the competent jurisdictional Court within the State of Karnataka and seek appropriate relief failing which, this anticipatory bail shall automatically get cancelled.
