C.M.P.No.10141 of 2024 in C.M.A.Sr.No.56203 of 2024 N.ANAND VENKATESH , J Mr.S.S.Santhosa Kumar, learned counsel, takes notice for the respondent.

2. This Civil Miscellaneous Petition has been filed seeking to condone the delay of 398 days in filing the Civil Miscellaneous Appeal.

3. Heard the learned counsel on either side and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 398 days in filing the above appeal is condoned.

5. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Mr.S.S.Santhosa Kumar, learned counsel for respondent, at the time of admission.

6. Learned counsel for appellant is directed to immediately serve papers on the learned counsel for respondent.

It is made clear that for the period of delay of 398 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
