(CRIME NO.147 OF 2022) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) Modify the condition imposed by this Hon`ble Court in Cr.OP.No.10816 of 2022 order dated 18.05.2022 to deposit a sum of Rs.5,00,000 jointly to the credit of Crime no.147 of 2022 before the concerned Magistrate, with in period of three weeks from the date on which the order copy made ready and to pass any such other order as deem fit and proper in the circumstance of the case and thus render justice. [CRL.M.P.Nos.7145 & 7149/2022] Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.D.LAKSHMIPATHY, Advocate for the petitioner [CRL.M.P.No.7145/2022] and M/S.R.SATHISH KUMAR, Advocate for the petitioner [CRL.M.P.No.7149/2022] and of M/S.V.J.PRIYADARSANA, Govt. Advocate (Crl. Side) on behalf of the Respondent [IN BOTH PETITIONS] the court made the following order:-
These petitions have been filed to modify the conditions imposed on the petitioners by an order dated 18.05.2022 in Crl.O.P.No.10816 of 2022 to deposit a sum of Rs.5,00,000/- jointly to the credit of Cr.No.147 of 2022 before the concerned Magistrate, within a period of three weeks from the date on which the order copy made ready.
2. Heard both sides.
3. Considering the submission made by the learned counsel appearing for the petitioners, the condition imposed as against the petitioners is modified to the effect that the petitioners shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) each to the credit of Cr.No.147 of 2022 before the concerned Magistrate within a period of three weeks from the date on which the order copy made ready. Further, the time to execute the sureties is extended for a further period of three weeks from the date on which the order copy made ready.
