ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.12.2022, for the alleged offence punishable under Sections 8(c) r/w. 20(b)(ii)(c), 25 and 29(1) of NDPS Act in Crime No.32 of 2022, on the file of the respondent police, seeks bail.

2. The learned counsel appearing for the petitioner submitted that he is in custody for more than 2 1⁄2 years, but there is no progress in the trial. He further submitted that the co-accused has been released on bail and there was no recovery from him, based on the confession of the arrested accused, this petitioner was arrested. He further submitted that the petitioner is ready to abide any conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

3. This bail has been filed after the dismissal of an earlier bail application on 03.07.2024. While dismissing the petitioner's earlier bail application in Crl.O.P.No.14871 of 2024, this Court directed the trial judge to complete the trial as expeditiously as possible, within a period of three months. Now, after a

lapse of one year, this petition has been filed, stating that there has been no progress in the trial, despite the petitioner is ready to co-operate with the trial.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the trial is recently commenced, with PW1 examined on 22.08.2025, and PW.2 and PW.3 examined on 23.10.2025. There are totally 20 witnesses in this case. The trial is progressing, and the matter is posted on 31.10.2025 for the examination of LW3, 4 , 5 and 7.

5. Further this Court called for a report from the concerned Court, which revealed that the trial Court has not concluded the trial. It was stated that there has been no co-operation from the prosecution, and witnesses were only recently produced. The submissions made by the learned Government Advocate (Crl.Side) further revealed that the trial is now progressing and there is a possibility of completing it at the earliest.

6. Considering these facts, the trial Court is hereby directed to dispose of the case within a period of two months and submit a report in this regard. The respondent police is directed to produce all the witnesses as per the time frame fixed by the trial Court at the earliest.

7. In view of the above directions, this Criminal Original Petition is disposed of.
