O R D E R

This petition has been filed seeking transfer of O.S.No.7343 of 2012 pending on the file of the VIII Assistant City Civil Court at Chennai to the file of the District Munsif Court at Thiruvottiyur.

2. The learned counsel appearing for the petitioner submitted that there are two suits pending on the file of the District Munsif Court at Thiruvottiyur, namely, O.S.No.67 of 2014 and O.S.No.47 of 2015, between the same parties. In these circumstances, the petitioner has filed this petition seeking withdrawal of O.S.No.7343 of 2012 pending before the VIII Assistant Judge, City Civil Court, Chennai and transfer the same to the District Munsif Court, Thiruvottiyur.

3. In fact, the learned counsel appearing for the respondent has no objection for transfer of the suit in O.S.No.7343 of 2012 from the file of the learned VIII Assistant Judge, City Civil Court, Chennai, to the file of the District Munsif Court, Thiruvottiyur.

4. In view of no objection having been stated by the learned counsel appearing for the respondent, the suit in O.S.No.7343 of 2012, pending on the file of learned VIII Assistant Judge, City Civil Court, Chennai, is ordered to be transferred to the file of the District Munsif Court, Thiruvottiyur, for joint trial of all the three suits.

5. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed.
