O R D E R

This Criminal Original Petition is filed seeking a direction to respondents 1 and 2 not to harass the petitioner, in connection with the complaints relating to the illegal extracting and transporting of sands, from the Aroor areas within the limits of the second respondent-Police.

2. Learned Government Advocate (Crl.Side) appearing for the respondents-Police, on instructions, submitted that the petitioner is a history sheeter and earlier he was doing illegal mining business and that the respondent-Police called the petitioner for enquiry and there is no harassment as alleged by the petitioner. He further submitted that now, the petitioner has come forward with the present petition only in order to escape from the criminal cases, which are pending against him.

It is seen that the petitioner is a habitual offender and that the respondents-Police called the petitioner for enquiry, and therefore, the petitioner is directed to co-operate for investigation and at the same time, the respondents-Police should not harass the petitioner under the guise of enquiry/investigation.

4. With the above observations and directions, this Criminal Original Petition is disposed of .
