JUDGMENT

(Judgment of the Court was delivered by The Hon'ble Chief Justice) Mr.Sabarish, holding brief of Mr.S.Kingston Jerold, learned counsel for the appellant has advanced his submissions contending that the issuance of the notice is absolutely unnecessary and therefore, the learned Single Judge ought to have quashed the same.

2. We have considered the submissions raised and also heard Mr.T.M.Pappiah, learned Special Government Pleader for the respondent.

The learned Single Judge in paragraph 5 of the impugned judgment has given full protection to the appellant and therefore, no prejudice would be caused in case, the appellant appears and answers the notice in the enquiry itself and it shall be open to him to raise all such objections which are available in law which the authority concerned will be obliged to consider and pass appropriate orders.

4. We, therefore, find no reason to interfere with the impugned judgment.

5. The writ appeal is accordingly closed. No costs. Consequently, connected miscellaneous petition is closed.
